Kevin Spacey’s Lawyers Imply Alleged Victim Allowed Actor To Grope Him

A man who says he was groped by Kevin Spacey at a Nantucket, Mass., restaurant in 2016 caught part of his encounter with the actor on video, according to court records.

In the court documents, the then 18-year-old busboy told police Spacey arrived at the Club Car around 11.30pm while he was working.

The alleged victim, son of former Boston news anchor Heather Unruh, sent the footage to his girlfriend that allegedly showed Spacey touching the front of his trousers, according to state police reports filed in Nantucket District Court. That night, Spacey bought him a number of alcoholic drinks, bragged to him about the size of his penis, and tried to get the busboy to go back to his house afterward, the accuser told police in the complaint.

The then 18-year-old, a busboy at the restaurant who lied to Spacey about his age, saying he was 23, sent a Snapchat video to his girlfriend to prove the incident occured.

Unruh said in a news conference a year ago that her son didn't go to authorities sooner because of fear and embarrassment. While on his way home, Spacey texted him, "I think we lost each other", and the busboy did not respond, the complaint states.

It comes as Mr Spacey prepares to front court next month on a charge of indecent assault and battery against the teenager, who is the son of a Boston television anchor.

Mr Spacey remains under investigation on suspicion of a 2016 sexual assault in Los Angeles and also faces accusations of sexual misconduct from his time as artistic director of London's Old Vic Theatre.

At a hearing last week, Mr Spacey's lawyers said the video shows someone's hand touching another person's shirt, but does not show anyone being groped and that there's not enough evidence for their client to be charged.

The victim is the son of former Boston news anchor Heather Unruh, who said previous year that Spacey groped him at the Club Car bar in Nantucket, Massachusetts. Regardless, he says, viewers "want me back".

The accuser, now 20, said Spacey's alleged touching went on for about three minutes and that he tried to move away and moved Spacey's hands away, to no avail, the report states. In the YouTube video titled "Let Me Be Frank", Spacey, wearing a Santa apron, addresses the camera in the style of his Frank Underwood character on "House of Cards".

"You wouldn't believe the worst without evidence, would you?" he said in the video. You wouldn't rush to judgements without facts, would you? I shocked you with my honesty, but mostly I challenged you and made you think. He later adds, "If I didn't pay the price for the things we both know I did do, I'm certainly not going to pay the price for the things I didn't do".

Spacey's storied career collapsed in October 2017, when actor Anthony Rapp accused him of making a sexual advance at a party in 1986. In that same statement, he came out as a gay man, a decision sharply criticized for its seeming attempt to conflate his sexuality with a serious allegation of wrongdoing.
